- Hello there, wondering if you can help.
This case is referring to a long time ago and is rather complex.
I declared B in 2009,
I had my own asset which was being rented out but declared it under the B.
I was in dispute with my sibling over inheritance (my father had passed away suddenly just before my B and he was holding assets in his name but for me and my siblings beneficiary interest (father left no will- we are in a court case with him now).
Before declaring B, i had asked my father to help me with my debts and he had promised to help but passed away suddenly and i asked older sibling to honour dads promise since he had taken control over dads estate.
He refused but agreed to give me a loan for half the debt and said he is taking it against the said possible inheritance property and if i did not pay him back i would be ruining his credit and loosing any possible inheritance and he claimed he was using the inheritance to look after mum.
i had to pay him back a large sum every month which got me more into debt and eventually i had to declare B. I did not not put this debt on the B as i was too scared of what my brother would do to me following his threats and if i didn´t pay it back.
On the B application whilst i put the said inherited property as my address and claimed i would pay rent there but in reality i wasn´t living there and this was just me trying to find a way to assert my interest in it.
In the actual IPA arrangement my expenditures does not include this property and actually only relates to my own property.
During the IPA there were times when I was receiving income from my own asset but I don´t recall telling the OR and/or I did and it was not important or counted in changing my IPA -as my own asset had mortgage arrears, had no equity and low sale value because the lease was running very low. Eventually my own asset got returned back to me.
In my current case related to the inherited property against my Older sibling they have picked as to what they perceive as me lying to the OR or on my B statement.
That is
1.why didn´t i declare the possible future inheritance as vested interest in B form-(threats from my brother about future inheritance).
2.Why did i put the future inheritance as address and a possibly paying rent there ( i was only trying to make it known that I was fighting for this) but confirmed the reality to the IPA and it was not included in the IPA.
3. why didi not include the income whilst renting my own asset - i think i had spoke to IPA about this and the rental income was not enough to cover any debts or change the IPA amount - i think the IPA was cancelled after two years as I had lost my job.
I was young and afraid and didnt think most things through and I just want to really know if I am going to be in trouble for misguided application- is there a case going to be open up against me now for things they perceive as omissions when i thought i was just trying to save myself.

Because my brother has stolen my inheritance and I am going to court with him and now it has come up that I should have mentioned this possible inheritance even though I am only bringing a claim against him after 20 years and he is trying to undermine my claim by saying that I lied on the my B application.0
