  • That’s great, thank you. I’ll just let time pass and see what happens. Hopefully they won’t find the credit agreement.

The letters they send are generic, and not specific to everyone's circumstances.

If an account has dropped off your file, then no further reporting will take place regardless of what happens.

  • Thanks sourcrstes! It looks as though this is turning out quite well.  Haven’t heard from other creditors since acknowledgment of my request for credit agreements.  It’s been a few months, so looks as though they haven’t found any credit agreements either.

That would be amazing for you if they don't find them!

    Good afternoon all.

Continuing onto this thread as it is to do with Barclaycard and PRA.
Is writing to PRA offering FF settlement resets the statue barred clock?
    Appreciate your help. Thanks

We always recommend using the National debtline standard letter and amending it as little as possible

    https://nationaldebtline.org/get-information/sample-letters/full-and-final-settlement-offer/

You'll see that it is headed 'without prejudice'

'without prejudice' negotiations are done outside the court process and cannot be used as part of a court claim. Not all communications headed 'without prejudice' are genuine but courts have held that they are genuine if they contain an element of negotiation.

So follow our guidance and you should be ok.
  • Update! So, here’s where we are after sending the requests for credit agreements:

Sainsburys (with link) confirmed in writing as unenforceable

My Barclaycard (with PRA) confirmed in writing as unenforceable

Husband Barclaycard (with PRA) activity paused, pending documentation being found

    Bank of Scotland (with Link)
    confirmed in writing as unenforceable

Capital One (with Lowell) on hold pending documentation being found

    So far, so good!

Slightly concerned about Virgin. This is with Capquest.  They wrote a while back to say activity paused, pending documentation being found.  Had a letter today saying they have passed account to Resolvecall. There was a letter enclosed from Resolvecall to say that if I don’t contact them within 7 days, they will be instructed by Capquest to come to the house! What now? Can they do this?
