HELP! TFS Loans and conduct post administration

Sorry if this has been asked before but desperate measures ..

I (stupidly) took out a loan in 2016 and topped up in 2017 with total borrowed £5500 - plus their insane interest. I put in a mis-sold loan complaint in Oct 2020 which was rejected and went to FOS. An adjudicator agreed and returned report to TFS who still rejected so i went in the queue for an ombudsman to review in late 2021. Feb 2022 TFS went into administration. At this point I had now repaid in excess of £10500. They have been silent until 2 weeks ago when they emailed to say I hadn't been mis-sold and started harassing me and my guarantor to set up payments to clear the remaining almost £4k. I emailed straight in with my appeal info, evidence, FOS report and asked the account to be on hold until it was reviewed (appeals deadline is Nov 2024 and then could take 12-18 months to review all info?). Clear no from TFS. I asked if my loan was deemed mis-sold would the money I pay now be protected in full. Also no and would possibly be pence to the pound redress. The colleagues are unhelpful and aggressive and while I appreciate are in the process of losing their jobs have no compassion for those who have been financially vulnerable and used the companies service at a devastating cost.
I have spoken to FOS, CAB and FCA who have all pointed me back to each other. TFS have paused my account for 2 weeks while I complete I&E however I have spent years turning my financial situation into a better one and would pass affordability to repay but it seems wrong to be expected to pay when it wont come back to me in full. (Very confident in my case)
Anyone else in this situation or have any advice on where I can turn to?

To add, at the point of taking this loan and topping it up I already had a guarantor loan with another company and had topped that up 3 months earlier and was up to my eyeballs in payday loans.

Thanks in advance for any advice!

Have you complained to the administrators? You can get their email addresses here https://www.insolvencydirect.bis.gov.uk/fip1/. They should clarify if any payments you make now will be refunded in full if your appeal is upheld.
If you are convinced your appeal will be upheld, then you could ignore them? They arent going to take you to court while the debt is in dispute with an appeal ongoing.
  • Hiya, thanks for this information - absolutely worth a try for clarification. Unfortunately I cant ignore them as they have now said they will go after my guarantor which I would never allow. I have previously complained to the administrators with no avail however I will do so again for a paper trail if nothing else!
