They replied in less than a week. In my case the email reply went into my spam folder.jimlees said:
thank you i've sent it off and i'll await and see what happens also how long did it take before you got a reply ?KeithP said:DVLA Keeper is ok, but choose Other from the second list.
Anything in the second list with the word 'I' in it tells them that the keeper was the driver.
Their appeal portal will also show something like this...

You'll win as long as you don't say at any point who was driving.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Not only are Horizon not relying on PoFA to hold the keeper liable, the NtK would fail PoFA because the relevant land is ambiguous. I already have a successful POPLA appeal where the address of the relevant land on the NtK was ambiguous.
The relevant land on the NtK states it as "Iceland Doncaster". A quick entry of that into Google Map brings up two separate Iceland Doncaster addresses:
Iceland, Prince's St, Doncaster DN1 3NJ
Iceland, Thorne Road Retail Park, 4 Thorne Rd, Doncaster DN2 5DX.
Two completely different locations. It shouldn't matter in this case as long as the OP does not reveal the identity of the driver and only appeals as the keeper.
