Openreach Fibre Install

Hi

Can openreach engineers install a new overhead cable to a neighbouring property across my land while entering my garden without my permission?

    I assume you are talking overhead wires 

    Were you at home at the time 

    Do you really want your neighbours to not get their install ? 

    What are you after "compensation"  ?

    They shouldn't have assessed your garden to do it but if no damage is done

    When ours got installed they had to bring the cable across from a pole that was on our neighbour's property, the wire was going to go across the front of their house at a height that was about the mid-way up the upstairs window. When we my neighbour spoke to the engineer he was told that legally they have the right to do so as long as any cables are a minimum distance from any building on their property. In the end he was able to connect via another pole at the back of the house and the wire is just above the top of their windows there.

    NEVER EVEN THOUGHT OF THAT BUT NO WANT THE CABLE REMOVED AS THEY PREVIOUSLY TOOK THE CONNECTION FROM ANOTHE POLE

    They shouldn't have assessed your garden to do it but if no damage is done 

    'FLYING WIRES POLICY' STATES AS LONG AS CABLE IS 3 MTRS FROM THE GROUND AND 2 MTRS FROM THE HOUSE AND ENGINEERS DO NOT HAVE TO ACCESS NEIGHBOUR LANDS THEY CAN BUT THEY ACCESSED MY LAND WITHOUT PERMISSION

    If the cable is above 3m from the ground and 2m from the house you have no grounds to have it removed, OR going on your land is a separate issue. 

    Why did they actually do when on your property? If they just went there to check the clearance then I can’t see that they have done anything wrong. If they were doing more than that then yes they should have got your permission but under trespass law there is little more you can do about it after the fact apart from warning them not to do it again.

    Things that are differerent: draw & drawer, brought & bought, loose & lose, dose & does, payed & paid

    @lastbigspender just because the previous connection was from another pole it does not follow that the new fibre infrastructure is in the same place.

    Have a large G and T and forget about it if no damage was done and the cable meets the rules.

    No!

    You should force them to come back and remove the wire and you neighbours will just have to live without the internet - as you say it's not your problem.

    You sound like a lovely neighbour 

    Openreach have the right to provide services from ANY of their poles or cabinets. The cable "overhangs" your property.

    Perhaps they should have asked permission to enter your garden ( assuming they did , I'd have tied something heavy to the end of the cable and lobbed it over obstacles, it can then be lifted to pole height with a ladder and connected) 

    You have made an issue out of a non issue, but I assume from your replies that you will continue to simmer on the petty subject
