  • There's a similar story today in The Guardian about a family having their home repossessed. The couple had a £74K mortgage, but when the husband was unable to work after an operation, they struggled. The building society decided to take the repossession action when the arrears were £2,500. Another story was of a couple whose arrears were £2K when the court action was taken, but the repossession order was refused because the couple had children and the judge was not of a mind to make them homeless for £2K.
    Almost debt-free, but certainly even with the Banks!
  • the messages you have recieved about getting the order suspended are quite right and what will happen is that you will get a stay of execution ( SOUNDS HORRID ) in the interim as you are telling them that you were not aware of the proccedings being taken. You should then get a further hearing which will give you the right to have your say. Also yes contact shelter they sent some one to court with me to help with the legal jargon they were brilliant. Get on to the court asap you may be able to contact them on line or download the forms you need . Hope all goes well

    please do as medway queen says.Ive done it.its scary but the judge will be keen to be helpful,providing you can make arrangemenrts to repaY And keep to your mortgage from now on.it will all depend on your finances.
    go to court tomm for the stop if you havent already. try to do a weekly/monthly budget so he can see your problems.

    It's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.
    We dont count all the runners ahead of us & feel intimidated.
    Instead we look back proudly at our journey, our personal struggle & determination & remember that there are those that never even attempt to reach the starting line.

    i did try to post back last week but i couldnt get online with computer for some reason:mad: .

    i went to the court to try and get an execution of stay as advised by shelter but the judge wouldnt.

    i had to take my 3 children with me and he had a go at me because i hadd them with me.
    ..he was telling me that the court was no place for children ( i desperatly tried to get childcare sorted for them). he told my that my husband was irressponsible for not going to the court with me. ( i didnt know that i was going to court until lunchtime and hubby was already at work. the judge told me that i had to leave the proprty by 11am the next day and he suggests that i contact my local authority. which i already had but i then went straight round to council and managed to get appointment bought earlier from 3 pm to 12 pm.


    we are all in a bed sit ( 1 bedroom and kitchentte and bathroom), and was told council would be in contact next week sometime.

    rent for where we are though is £152 per week.

    i will get back on here whenever i can but obviously i have no interenet access at the moment. i just wanted to let people know the situtaion and thank everybody for there advice.

    Really sorry that you got an unsypmathetic judge & a jusgemetal one at that! Big hugs for you and sorry that they did evict you. Try & see it as a fresh start if yu can but I can understand why that will be hard :( My heart goes out to you...

    :mad: That makes me really mad - as if it wasn't hard enough for you without the judge needing to make things even more difficult.

    I hope things start to get better for you soon (and that on the judge's next visit to the toilet, he has to squeeze out a hedgehog).

    So sorry to hear you had a {insert rude words of choice here} for a judge!! More often than not these people are so out of touch with the real world! I really hope things start to get better for you very soon!
