HMRC misinformed about my income

Hope everyone is having a lovely Friday today. 

I was wondering if anyone knows what the best thing for me to do is: 

I went through my employment history in my tax account today and it turns out my old employer has misinformed HMRC about my earnings by a total of £2700. 

My p45 is different to what's on the website and there is 1 payment that it says has been paid to me in October and 1 in November last year (a month after I left). My bank statements also don't show those payments.

Could this be a common mistake? I'm awaiting a response from them as it's a small company and doesn't have an HR department. This also isn't the first time I've raised a concern about missing payments. 

Obviously this affects any PAYE Tax rebate and I am likely going to be doing this the long as they wont rush to give me a response. Should I contact the accountant directly?  Do I have any rights? I can go via HMRC but they'll probably tell me to contact the employer first.

I have also settled out of court with them for missing wages of £1900 but I received that through acas 3 months after my p45 was issued.

  • Don't waste your time querying this with HMRC.

    They will simply advise you that that is the information your (ex) employer has reported and it will be (automatically) updated once your employers a corrected Real Time Information submission.

    And before losing any sleep over this you might want to consider the actual impact it will have on your tax liability.

    Will it generate a tax refund?
    Or generate an underpayment of tax?
    Or have no impact?
  • It will generate over about £300 in tax refund. 
  • Also I don't think they will change it as according to HMRC I am still employed by them.

    You can report that you no longer have that source of income. If you've got a P45 then HMRC should also have that.

    Your old company will have to resolve it in their payroll system.

    It is relatively easy for them to do if they understand the payroll system.

    The payment through ACAS may have caused them some issues though. How has that been reported to HMRC?

    Very good point.  I have no knowledge of what happens when done through ACAS but normally when a payment is made to an old employee after the issue of a P45 there would be a deduction of tax/NI reported to HMRC. This would then show as figures on tax record that were not on the P45.
