this will result in one outcome for the OP ,'redundancy' as there is no work over the winter and a note that their were SNLR and not to re-hireMalale said:In such a situation, you have the right to refuse the proposed change and continue to perform duties consistent with your original role. I do not read the situation like this.Malale said:In such a situation, you have the right to refuse the proposed change and continue to perform duties consistent with your original role. Legally, your position is based on the fact that a change in your role is a material breach of your contract.
They are still doing their original role. Their original (current) role says they are to work with maintenance when the water sports centre is shut. OP is interpreting shut as meaning 'out of season' (i.e. Oct - April). The employer could be interpreting 'shut' as meaning 'no bookings'. So, for example if there are no booking for the centre tomorrow the centre is 'shut' so the OP could work with maintenance in this situation (unless walk ins are a thing?).YNWA
