Hoping someone can help me!
I received a letter from resolvecall a few weeks back regarding an outstanding balance of over three thousand pounds. This was apparently taken out about ten years ago and have heard nothing from them, fyi I don’t remember this or not sure if my ex partner did it! He did leave me with lots of debt. Anyway fast forward I sent them a standard statue barred template from step change and have today received a letter from them saying I made a payment of two pounds in January 2019. I checked my bank and no payment has been sent to them and they have said the debt is not status barred. Where do I go from here? Plus they showed up at my door a few weeks ago?? I was not home but it has me worried. Any help would be greatly appreciated. The debt apparently was with capquest who then sold it onto resolvecall

    I'd send them a prove it letter.  Prove that you owe them anything and prove that you made a payment.  Chances are there will be insufficient evidence that you took out the debt and also that it was transferred correctly to the subsequent agencies.

    Don't admit there might have been a debt at any time even if in the distant past. 

    Should anyone show up again at your home do not let them in even if it's raining and blowing a hurricane.  Tell them to stop harassing you.  If they get pushy have your phone available and start filming them as evidence for the police.

    Resolvecall very much in the news on this forum at present, as with any demand for payment of a debt you do not recognise, you send the provit letter to them, see what response you get from that.

    What is a prove it letter? Do you have a template for that?

    What is a prove it letter? Do you have a template for that?

  • Thanks all for the template, I don’t know who the original creditor is though? I have to put a name down in the template but don’t know, sorry can I just put questions marks??

    The fact that you don't know the original creditor gives more weight to your question - this is you demanding that they prove that you owe the debt to whomever. You have the power here, you have a right to be indignant, supply whatever reference they gave on their communication to you and adapt the letter to your circumstances. Don't give them your phone number, email address, any personal info other than name, address and reference number (which they already have). This is you asking what the hell this debt is about, so you've every reason not to know the original creditor

    Generally you send a prove-it letter first and then, if relevant, send a statute barred letter.

    The problem with doing it the other way around is that you are saying 'this is my debt' I know its history' and 'I did not acknowledge it for a period of six years'

    In this case what would I do?Just say I've made my position clear and refuse to engage.

    The alleged payment will be completely bogus but even on their evidence the debt is SB in 9 months if you live in England.
