  • If you are confident the Estate Agent's valuation was correct and could be defended if the IHT part of HMRC challenge it in due course, then clearly the CGT route would result in less tax.

    It's a judgement call for the executors as no one in HMRC will tell them which way to go especially when the crux of the matter is the market value of a probate property.
