    Yes, agree on the unfair practice issue, and no CCA not applicable unfortunately, the court of appeal ruling was in 2015, I found an old thread on MSE about  NRAM from that time.

  • Hi. Thanks everyone for the comments so far. There was a complaint raised via Landmarks complaints procedure but it came back in their favour. They basically said that they are not doing anything wrong in terms of the rates they charge and they supplied a copy of the original Northern Rock terms and conditions. In my opinion, although they don't appear to be breaking any financial laws, it is morally wrong what they are doing - taking £4k per year of my hard earned money and not reducing the overall debt by a single penny is just sickening and wrong. And because we have built up arrears with them whilst on the DMP with Stepchange, we are unable to obtain credit anywhere else in order to transfer the balance to another lender, due to the very poor credit score we now have. We are truly stuck with this and fear we that this debt will never be repaid, only if we had a win on the lottery. In the meantime, they will continue to take £4k per year from my bank account !

    They do provide a yearly / annual statement for those who've asked.

    I posted a link to Conc 7 earlier. It is about how a firm collecting a debt must behave towards the debtor.

    Use that as the basis of your complaint, e.g. 7.3.5 talks about suspending interest where the debtor can afford to make a payment but applying interest would cause the owed sum to rise.

    It's really about defining fairness, and you can use it to show that you have not been treated fairly. Landmark will disagree and then you refer it to FOS.
