Frozen pay for 11 years - any similar experiences?

    I'm no lawyer but I can't see you have a case. You weighed up the options and opted out of the new contract and retained your old T&C's, but that came with a pay freeze. Unless the lawyer you have spoken to is taking this on a NWNF basis I would be very wary.

    I'm guessing that the salary the OP and colleagues was on was above the upper limit for the new payscale and therefore they were 'marking time' until the new payscale caught up.  If that is the case there is little they can do about it as that was the option they took.  If the new payscale now exceeds their old one they should, in my opinion, now be starting to see increments again.  Without full details of the comparative pay scales it's difficult to judge.
    I had something similar following a company merger.  My role changed but I retained my old salary which was far higher than the scale for the new role.  It did mean I didn't get any payrises, but I left after a few years and was still way above the new grade so was still better off.
  • My understanding is that your pay is still above the banding for the job so you are still better off than your colleagues who are paid on the actual pay scale for the role. I’m not sure there is any case to answer as you are in effect on protected pay and paid a higher rate than some of your colleagues who are doing the same job as you.

    In which case it is purely a matter for negotiation. There is no legal right to a pay rise, ever, unless your pay were to fall below the NMW.
