Well I hoped that HCEOs would be open about this but from looking at some of their websites, that was naive of me. They do not like the legislation and want it abolished.

Debt advice organisations like Stepchange an National Debtline state it, and some solicitors e.g.

    https://www.whnsolicitors.co.uk/newsroom/news/how-to-recover-debt-through-bailiffs-and-enforcement-officers/

However, I did find an article complaining about it on the HCEOA site

    https://www.hceoa.org.uk/news/187-judgment-enforcement-time-for-change

This clearly states that the relevant legislation is s8 1 a of the HCJO 1991

    https://www.legislation.gov.uk/uksi/1991/724/article/8

That’s really helpful thanks, worth asking though how to be sure these guys are HCEOS, is that simply by default? i mean could he just say he’s not he’s something else?
They'll have ID cards to prove who they are and they will have a copy of the writ from the high court. Most Enforcement Officers (as they're now called) will operate at multiple levels not just high court so their ID won't explicitly say they are HCEOs so thats where the writ confirms if its High, County etc

I suspect you will be told that this credit card is not a credit card. That's why i suggested that cca specialist solicitor earlier. Not to get them to take you on, just to ask the yes/no question.
  • So i just borrowed the money to pay this, off a friend. Which obviously makes my situation even worse but i frankly haven’t got the health or the bandwidth to fight it, and with this man threatening to send his ‘team’ up at 6am tomorrow, i am at home alone with 3 children, who will all come outside and ask what’s going on, i just can’t face it. I’m kicking myself for not dealing with it sooner and letting it get this far, but for various reasons i won’t bore people with my eye was off the ball when it went to court and I’ve stupidly been ignoring it since alongside all my other debts.

I know it achieves nothing but I so want this man to pay I get it he’s doing his job (and doing it quite well clearly), but to be such a p****k about it, and effectively use intimidatory tactics, i mean its just not right. I’m grimacing at the thought of him swanning about in telling himself how brilliant he is…’i get results’ !

I’m now in a panic about all these other debts going the same way

What is your plan with your other debts, do you have one?

Legal action is quite rare, you just got unlucky on this one, if you want help with your other debts, now would be a good time to ask.
