We are in the same boat! Except Nasty West are taking us to court for a £5k overdraft! Thing is I didn't think and also according to the info from debtline that they can charge interest ona debt of £5k or less and also this is an overdraft! The info we are receiving is confusing to say the least. We have just returned court papers as they are seeking to impose a charging order and I have also requested from them a statement showing how the interrest and charges have recently been applied. An interesting thing tho, CCCS (who we have a DMP with) advised that if they take us to court, (we have recently increased our payment to them to £83.38 a month from £50.50) and the judge deems our offer to be fair, then even when we review our account and increase our creditor payments, Nat West shoot themselves in the foot as we do not have to increase the payments to them, once a judge decides the offer is fair!!
We fully intend to increase our payments in a couple of months as we want to pay off our debts asap! Good Luck with this, and please keep us posted I am going to keep firing questions at them, not in an attempt to stall this, but to generally make life as difficult for them as they do to others!Debt at Sept 2006 £63,500:eek:

yep i think i read your thread about N/W, its true that both partys have to go along with the courts judgment. so yes natwest could shoot themselves in the foot especialy if they dont get a charging order.
im not that bothered about the charging order really although it will be nice to avoid them getting what they want, if we move or re-mortgage then i will pay all my debts of anyway and we intend to do this in the next 5yrs. what im more concerned about is the interest and charges there smacking me with, as to date ive payed close to 5k to them and not a penny has come off the debt, infact its gone up!!!
im hoping a judge will think my offer is a good one (£233) and grant it, but NW will no dout be asking for the full amount in one hit so as to force me to default so they get the C/O, but this has to be agreed by the judge as being resonable which it obviously isnt, but according to the cccs it does happen sometimes.
we will at the least end up with a CCJ, but ill never want credit again anyway, apart from a home loan and we should have enough equity in our house when we move so as not to cause a major problem
please let me know how you get on with it0 -
CCCS told us that too! We didn't even get a letter from the solicitors acting for NW, just a menacing phone call, and then the court papers arrived! CCCS told us that RBS who own NW do follow everything up! I think your offer is more than reasonable, pity the same can't be said about NW!!! I sent them a letter via Special Delivery last week just before we received the court papers, asking them where the payments have gone which were made via CCCS totalling over £750! im going to be asking the same, but i think claiming the charges back will be a different case to them taking us to court, but it will hopefully make our side look better on the day. im going to put a letter in with the court papers explaing everything and that i have made a lot payments to them etc etc and that im waiting to here were the money has gone..
out of interest on your court papers what did they put down for court fee's and solictors, mine was £350 court fee and £100 solicitors. i havent checked yet but thought £350 was a lot for a county court claim..
i also think your offers is a good one seeing as its only a 5k debt, thing is i think its just there policy to go to court if you have a property, probley wouldnt bother otherwise..

It was about £250, and I agree I thought this was a lot. Still confused tho, because according to the info from debtline they cannot charge interest on a debt of £5k or less, and the last letter from NW was dated in May 2007 agreeing to a 6 months repayment plan before review. Have also sent this with court papers! How can you start with £5k and after £875.33 in payments owe more??? They apparently have applied 8% interest against the debt for December!Debt at Sept 2006 £63,500:eek:

i too got the letters about the 6 moth payment plan, but no mention of interest or charges. wasnt untill i spoke to them they told me my payments hadnt reduced the debt..0
