Giving a bad reference during litigation

    I note you've not responded to this question (as is of course your right). What are the financial consequences (if any) in terms of legal fees if you drop the litigation? Continuing it seems to be a recipe for self destruction; the old saying 'justice delayed is justice denied', and if you see this going on for years, the outcome can only ever be a detriment to you. It's not easy to drop a case, especially when you are so determined that you have been shamefully treated and are determined to 'get back' at the employer, but your posts suggest that the real harm will be done to you by continuing.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!  
  • There's no detriment if I withdraw the case? That's covered in the written contract. I specifically requested such a clause. I don't want to "get back" at my employer. I do want to "get out" from my employer!!!...because I have a job offer which I dearly want to take up.
    Sadly, the new department has today requested their oh to review his finding that I'm fit for the new job.
    I hope he won't do that but don't hold out much hope.
    As to the other comment re: getting out from my current employer-my specialist was quite specific-he put it in writing-that my current employers refusal to listen to his professional opinion had caused me significant harm and therefore I should be given ill-health retirement.  That was refused. So I went on career break. Working volunteering.  Job offer new department.  Looks like it'd ebbing away :(

    Unfortunately doctors don't always understand how ill health retirement 'works'. You need to meet the specific conditions for ill health as set out in the rules of your scheme - and those conditions certainly won't be 'employer refused to listen to my doctors which caused me harm'.
