CGT - sale of overseas land

Context:
Some 20 odd years ago my parents purchased land in Northern Cyprus with their money, but the land is in my name. They now wish to sell the land. The sale money will go to them. This means all transactions have gone through them and will go through them with no financial activity from myself.

My question is:
Who is LEGALLY responsible for performing a tax return on any CGT due? Myself, or my parents?

  • To qualify this a bit further. We are all UK citizens living in the UK. The land is just land, no dwellings.

The land is in your name so it is your responsibility. The money going to your parents will also be regarded as a gift from you so may create an IHT issue should you meet an untimely end.
  • Thank you so much for your reply. I don't suppose you have any documentation to support this do you?

Land is in your name and you are responsible for any capital gains tax both in Cyprus under their rules and in the U.K. under foreign capital gains.
Nothing to do with your parents who have never owned anything.

Under any double taxation agreement you are able to claim relief for any tax payable in Cyprus against capital gains tax payable in the U.K.
