myself and wife have debts with RBS bank, mines are loan and credit card, (wife has credit card debt, opened in 2013) mines being dealt with moorcroft. my debts had defaulted ages ago.
moorcroft supplied CCA and I make payments to moorcroft.
but my wife's CCA request went directly to RBS on the address on her statements, think it was town in south coast if England, arrears department.as her debt was never sold by rbs or dealt by a DCA
her RBS credit card is showing as active on her credit report, but 2 months in arrears, don't know why. we had been paying on a dmp for nearly 20 months, until we came off it, in October, when we made the CCA requests.
she has paid nothing since October and not even had any letters at all from RBS.not even an acknowledgement.
she has proof the letter arrived, cos it went signed for , recorded delivery and was signed by RBS in October on delivery.

Companies do not always acknowledge receipt of CCA requests, this can be for various reasons.
Laziness, incompetence, bad management, or plain old forgetfulness.
Which of these reasons applies to your circumstances, is anyone's guess, you can send a reminder letter, but risk it being dealt with in a similar manner to the first one.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. well I guess it will default, then if they try to take it further, the defence is you never acknowledged or acted upon our request for a cca agreement .
I always wonder when folks defend a debt by stating the creditor wrote that the debt is unenforceable, what about stating the creditor never replied to state it was enforceable or unenforceable?
sending a reminder may only encourage them to look harder?
but I read that's if a creditor fails to respond, they are in default of the debtors request. as part of the consumer credit act rights of that personChristians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

I always picture in my mind credit card staff rummaging through basements looking for paper agreements.
but in reality we took our credit card out electronically , so you would think all it takes is the press of a button or two on a laptop and volla, there's the agreement.
maybe they got the request, then lost it somewhere in their departments.
but months to press a button.? or are they too busy or understaffed , incompetent or lazy as suggestedChristians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

maybe one day an ex credit card or bank
employee will post here and explain exactly what goes on.
or someone make a YouTube or channel 4 programme, bit like heir hunters!
like you said maybe they keep them hanging on on purpose, but you would at least expect an acknowledgement from a huge bank such as the RBSChristians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

If they acknowledge it then they have to say that its unenforceable until they supply the CCA, if they dont acknowledge it they can hope you start paying or they can continue to hassle you.0

out of the 10 creditors we wrote to, only 2 have failed to acknowledge the recorded delivery letters sent 3 months ago are
RBS credit card debt£1300 , still showing as active and simply be catalogue for £43 also showing as active in credit report.
simplybe still send monthly statements stating you are now in arrears.
every other creditor has been on the ball in responding with our requests .
Tesco credit was the fastest , in 10 days with the CCA agreement sent special delivery ( where lazy postman put it thro letter box without knocking, so it never got my signature)Christians Against Poverty solved my debt problem, when all other debt charities failed.
