Council tax re banding claim whilst probate is processed.

Hi,

My brother sadly passed recently and we are in the very early stages of the probate process to deal with his estate.  Whilst sorting thru the necessary documentation it is very clear that his property is in the wrong Council tax band (last house in street at a different band).  My question is that is it possible to submit a council tax re-banding claim as his executor with / if successful,  the repayment to recompense the error made to his estate ?

    The executors of an estate can appeal the band as they would be the liable persons in respect of paying the CT. Unless all the houses in the street are exactly the same, there is the possibility that the band is correct. The Valuation Office Agency (part of HMRC) will deal with the rebanding, the council will deal with any refund
