Notice Handed In and Internal Jobs

Hi, 

I am currently employed by a local business, who have created a consortium (regional Team) to provide services on behalf of 4 businesses in the region. However last year we were informed that the team would be de-regionalised and would return a local team. This is anticipated to be in April 2024. 

I am employed by the lead business (funded by all 4), however we will have the option to choose 1 of 4 local business team. It is undecided whether we will have to apply for our job roles (or promotions), which will be advertised internally first. Or whether we will be TUPE over. It is unclear what the new structure, job titles will be, however if we are not TUPE over there is possible changes to Pay, Annual Leave and other additional work benefits, depending what each local business team I decided on. 

Because of the uncertainty, and the possibility that I may need apply for roles, which may result in poorer working conditions, depending on the local. I have decided to apply for other jobs, with similar benefits/ pay, which I have been successfully offered a new role (Significant pay increase). 

I have not handed my notice in yet (which is 3 months), however during those 3 months, it is likely that the structures, pay and benefits will be agreed in those 3 months. Now I assume that I won't be able to be TUPE if I have handed in my notice in (which I don't think will be an option anyway), however, does anyone know if will I be able to apply for internal roles. 

I would certainly like to remain with one of the businesses (at higher level role), however I am unsure whether to accept the new job offered, if it may restrict me applying for the internal roles.

    TUPE would only apply if you went from working for Company 1 to any of the other 3 without being given a choice in the matter. The fact you are working your notice will not necessarily prevent your being transferred, when we TUPEd our call centre to an outsourcer everyone went whether a new starter, 20 years experience or currently working their notice. 

    You're free to apply for other jobs whilst working your notice, internal or external, but clearly may be burning bridges if you were to accept the current external job offer and then rescind that acceptance having received a better offer later.

    I would discuss it with my manager and explain, due to the uncertainty, I have been looking at my options outside the company, that I've had an offer, but I would prefer to stay if a specific role is a possibility/if I can be assured my working conditions would not be less favourable in the new role (whichever is most important). My ask would be confirmation of the need to apply for roles and that I would be allowed to apply even if I was working my notice. 

    That said, where I work, there's a non-zero chance the conversation would result in me being 'matched' to the role in question... (it's not a good thing, but job descriptions are sometimes obviously written to give a specific candidate an excellent chance at interview). 

    However, that approach would depend on your relationship with your manager/how your performance is viewed by the company and if the company is the type to hold it against you that you have been considering leaving...
