Maternity and Paternity Rights

My employer has just announced an enhanced paternity and maternity policy effective from Jan 1 for babies born in 2024. What right do employees who have had babies in the last few months have to access the enhanced plan. Maternity is increasing from 12 to 26wks

appreciate it’s an enhanced plan so perhaps no divine right but what are your thoughts on ability to challenge the stance of only allowing new babies in Jan to benefit and not retrospectively supporting employees?

  • This board is for welfare benefits (and not discussing policy) so you might be better off posting on the employment board, if they allow policy discussions on there.

    As long as they're complying with the legal minimum I'd think no rights as such.
    Any changes to a company policy of enhanced benefits has to have a start date which means there will always be someone who falls the wrong side of the starting point. 


    No harm in asking though.

    Our company is doing similar and has been very clear that for babies born on 31/12 old policy applies, born on 01/01 new policy applies.

    And as said no grounds to challenge it for babies born before.

    It may be one for HR to discuss with your union to get a rising scale for those popping sprogs out a bit too early.

    How far back would be fair?

    1 st December?  What about the baby born 30 November?

    1st November? What about the baby born 31 October?

    No matter what date they use someone will just miss out.
  • From an employers viewpoint it was wise not to announce the policy a year in advance, it could have lead to a spike of births early next year.
