Daughter at College should I still be paying Maintenance?

Hello 

My daughter has just turned 19 and since August last year, she has been at college doing an NC College course in Health and Social Care - scqf level 5 after she left school. she is also working.

I've still been paying child maintenance. Should I still be?

    I had to look at the Government and educational guidelines for Scotland to be as accurate as possible in providing some guidance as below:

    1: Child Maintenance is payable upto the age of 20 if a child is still in full-time further education and not higher education. The level 5 course your daughter is studying for would appear to count as further education so it qualifies.

    2: Child Maintenance is still paid even if a child is working

    3: Child Maintenance is still paid even if a child is not living at the receiving parent's home 

    To answer your question directly, the answer is "yes, it is still payable"

  • Our daughter did a very time-intensive science degree. Both of us sent her money every month even though we were divorced. Obviously we were in a position to do this. I for my part went back to doing a reasonably well-paid but stressful job for the duration.

    Presumably you have an arrangement via the Court or Child Maintenance Service, if not then whatever you decide to pay or not is at your sole discretion.

    No this was a private arrangement in that I was paying the daughter's mum.

    In that case there is no legal reason for continuing payments - these only apply in the event of a Court Order (usually as the result of a Settlement due to Divorce, or if one parent applies the the Child Maintenance Service. If you want to review the arrangement on account your daughter is working and so on then that would seem reasonable (to me).
