Imagine having your own bespoke radio station with your best friend, your mum, dad, sister or brother, your husband, wife, boyfriend or girlfriend or your best bud at work… With all of your favourite songs and artists, your favourite features - tailored especially to you. Plus, everyone you know will be able to tune in!

TERMS AND CONDITIONS for “ABSOLUTE RADIO YOU” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: https://www.bauerlegal.co.uk/competition-general-terms-and-conditions-20190304 the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

 

1.ENTRY ROUTES AND COSTS	Entries are restricted to one entry per person.   Entry to the Competition is available via the following routes:   (A)    Online at https://planetradio.co.uk/absolute-radio/competitions/   Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	Entrants will be given the opportunity to win their own, personalised Radio Station called Absolute Radio You. Absolute Radio You will be broadcast across a range of platforms for a limited period of time, to be determined at Bauer’s sole discretion. Absolute Radio You will host a selection of personalised music choices, guest appearances and bespoke features personalised to the winner.   Entrants will answer a series of questions relating to Absolute Radio at https://planetradio.co.uk/absolute-radio/competitions/. The questions will relate to running a radio station, for example taste in music and how an entrant envisages their own radio station and how they would make it entertaining.   Entrants will be shortlisted on the answers to their questions with reference to the judging criteria below. Shortlisted entrants will be invited to come on-air and pitch to the Dave Berry Breakfast Show why they, deserve to win their own bespoke Radio Station.  [JR1] There will be two winners of the Competition. All valid entries will be pooled and the winner will be selected by a panel of judges which includes an independent judge. The judges will select the winners on the basis of the submitted answers with reference to the following criteria:   The most creativity demonstrated Best entertainment value likely to excite and attract audiences Appropriateness for the broadcast on air and the Absolute Radio Network Audience A good fit with the Absolute[JR2]  Radio brand values
3. ENTRY PERIOD	Entries must be submitted during the following entry period:   From 8th December 2024 at 08:00 (the “Start Time”) to 19th January 2024 at  10:00 (“End Time”).   Entries received before the Start Time or after the End Time will be invalid.   Winner Announcement. The name and the hometown of the winner(s) will be announced on 26th January 2024 on-air and on the Absolute Radio Socials.   However, if the winners cannot be contacted on the contact details provided within 1 day from the date of 26th January 2024, then we will select another winners from the[JR3]  shortlist with reference to the judging criteria.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry. Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.   Other entry restrictions are as follows:   The Winner must be available on or around 26th January 2022 – 29thFebruary 2024 to travel to London, Government COVID restrictions permitting.   Subject to change the winner will be recording one four hour show which will be available on all Absolute Radio Platforms.   The winners will be required to sign a release form on the day(s) of recording to use all forms of media and to speak with Bauer Media Press.   If you are nominating someone else, please ensure that you have permission from them.[JR4]    Bauer retain ultimate editorial control over the Absolute Radio You show and shall own and retain all  intellectual property rights  in any and all recordings created by the winners or which the winner takes part in. The winner acknowledges and agrees that their prize is to attend Absolute Radio and personalise some aspects of a show and that they are not receiving any remuneration in respect of this participation and shall not be entitled to any fees or royalties as a result of their participation now or in the future.
5. THE PRIZE	Two winners will receive the following prize (the “Prize”):   One bespoke Absolute Radio Station AKA Absolute Radio You for a limited time frame across selected Absolute Radio Platforms.   Return travel to Absolute Radio, One Golden Square, London W1F 9DJ – Government COVID- 19 restrictions and advice and Bauer Media COVID-19 policy permitting. Such means of transport to be at Bauer’s sole discretion.     Sustenance, spending money and any costs incurred by the winner at the hotel (e.g. room service) are not included.   The Prize is provided by Absolute Radio / Bauer Radio Limited (the “Prize Provider”). We are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.   Prizes are non-transferable, non-refundable and no cash alternative will be offered.

 

OTHER CONDITIONS

 

1.       DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2.       INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station/magazine or any other radio station/magazine which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and/or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes on radio, in magazine or otherwise. You will also have waived any moral rights or right to payment that you may have had.

 

 

3.       MISCELLANEOUS.

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.

 [JR1]I have deleted as my notes from our chat with Harriet and Paul said we wouldn’t be doing nominations. If we are you can keep this wording but above in “Entry” include a line to say “Where you are entering on behalf of another person you must submit their details and have their full permission to do so”. I think it may be cleaner to keep it as entering for yourself given you have to answer questions relating to your personality/taste. If you go down the no nominate route – there’s another reference to nominating below in IP
