PayPal / Westcott

Hi All,

I seem to have an issue where Westcott are chasing me to pay a Paypal debt which I am currently disputing.

Obviously different departments do not talk to each other here. 

I've had 2 letters and a bunch of calls, which I have ignored after reading some online advice to do so. 

When I have spoken to PayPal, they do not care that there is a dispute via my bank, they just want to settle the debt. 

My question here, is can Westcott turn up at my house or bring a CCJ against me while this is going on? I would also ask, seeing as it seems there is an internal disconnect within PayPal, can they issue a CCJ while this dispute is going on? 

My only concern here is risking a CCJ or something which can harm me whilst I continue the dispute. Or should I settle to avoid risks and continue the dispute?

    The answers to your questions are no and no.

    I mean they could send someone around but it would be a waste of everyone's time, and Wescot don't do this.

    Wescot also can't get a ccj because they don't own the debt.

    If paypal  wanted to start a court claim you would defend it. Before they could get to that stage they would have to send you a 30-day letter with standard reply form

    Which they will not do as PayPal do not (to date) take action through the courts in the UK.

    And Wescott are just a 3rd party interloper with no more power than next doors cat, so you can ignore them too.

    Must say, seems like an open door for people to take advantage of PayPal if no repercussions..

    Well, PayPal are currently in the process of becoming FCA regulated, and moving operations over to PayPal UK, so the situation may change in the future.

    Previously they were based in Luxemburg, which created issues over which country any legal action could be taken in for UK based customers, watch this space.
