Stamp duty on council land

We are looking to purchase some land from a local authority to extend our garden. Council have given the go ahead but unsure if we need to pay stamp duty on the land?
The land is currently under local authority housing and would connect to our garden directly. We own our property and the land it is on. Its a small section and they are asking £5350.

Current minimum transaction amounts which would attract SDLT are £150,000 for non residential (including land which is not part of a garden) and £250,000 for residential.
So either way your intended purchase price is way, way below the SDLT thresholdIf you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales1 -
