Also, the law firm Seth Law told me that they do believe have been mis-sold without me paying them anything,. They had my case for over 18 months but, out of the blue, have just told me that they have no chance to get it to court because they say they only got my case 18 months ago and that is the first time they think I knew I had to complain but this really is not true as my first complaint with the broker was over ten years ago it has just taken me this lelength ofime to get a solicitor to acke on and believe my case.
These are the ones who dididhe teten-pageortgage audit and baMimmsysell claimlinglaim at £278,000 andMimis mismamanagement £23,000
I feel itey are going under them and this is the reason they are cu, I I me loose, I phoned them yesterday and explained what I had found about the gazettesaidnd the staff said nothing about it.
The questions in the are considereddit are the same thing that the adjaskedas asking for proof of of all them years ago.

The broker came to the house once, filled in some of the form, left the income blank and you can see on the form that some of the form is typed and some is written. I was on a wage with a business that had just been running around 12 months. I was on tax credits, a single parent with five kids, one only being 12 months old. I didn't see the mortgage form again. Don't forget I was so naive and so was my aunt. We basically trusted the broker. Not everyone had the knowledge of how to get a mortgage and you go to the people who are meant to have the answers and you put your trust in them.0

What happened to the £30k you didnt need/want?

I learned it was left over once the mortgage was set up by the solicitors dealing with the mortgage once they had paid out all the stuff that needed to be paid with the mortgage.
I got a phone call in the afternoon asking what bank account I wanted this money paid into, I phoned the solicitors and asked about what money and if I could send it back because I didn't ask for it or needed it. They said no, the mortgage had been completed, so it went into my bank, and we used it for our business. And yes, you will all say, well, you spent it, so it's your fault, but yet again, I was extremely naive at the time.
It was never spent on the extension I already had 3 years before.
I had no idea about paying it off my mortgage, and the people who were meant to be helping me suddenly disappeared0 -
Im not saying it is your fault.
But if I ended up with £30k I did not want/expect, I would have been on the phone to the broker to find out how they got it so wrong at the time - higher repayments, more interest and £30k I have no use for.
In the real world, there is a good possibility I would have spent some of it.
But you are basically saying I was given £30k, I have spent it I dont want to pay it back because I should not have been given it in the first place. You are an adult, you have to take some responsibility.

Im 58 years of age, I have took responsibility for this mortgage for 20 years,
I have never been able to move to a repayment mortgage because no one will take me on due to my income even only a few years after I got this mortgage
Also who will take on someone aged 90 in a joint mortgage
How was I meant to pay it back when no one would tell me what to do and told me that the mortgage can not be altered after completion.
It did also help me pay the £1,000 payments for the first few years, but 16 years down the line, I am unemployable these last few years where if I had been able to move to a more normal mortgage and not a sub standard one I could of got myself out of this mess I now find myself in.
Also hindsight is a brilliant think and please don't judge me until you walk in my shoes.

A complaint at that point would have had merit. No complaint at that time and using the £30k ends that argument.It was never spent on the extension I already had 3 years before.It was spent though. The complaint has been about being a mortgage prisoner. when I took this mortgage out after a couple of years I was still in the same position and I could not move to a repayment which I was told by the broker that I could change this mortgage in a couple of years, I still can not change this mortgage so I have ended up with this interest only mortgage all our mortgage life.
Also I could never get an insurance to cover the final amount at the end of the mortgage.0 -
I gather all the lies they told to make sure my mortgage was 30k over what we needed is not a problem, they made stuff up, I have written evidence of this in the eyes of making up about an extension and planning permission. Why are they not called into line for doing this, this was just pure lies the broker made up as well as my income which made the mortgage amount totally unobtainable in another mortgage. If it was an upfront mortgage surely I should of been able to move to a repayment mortgage just a few years down the line.0

I don't see any party in the history that's going to hold their hands up 15+yrs down the line4
