well one of my creditors TESCO bank has sent me their reply to my cca request, for my Tesco credit card debt.it came 1st class special delivery ! in under 2 weeks.
I wish to add tesco have not sold the debt on, but it has defaulted over a year ago.
I pay them via stepchange and have done since day one of the dmp.
the very lengthy letter states--
please find--
1.original true copy of agreement
2.original copy of terms and conditions
3. original copy of credit agreement as varied
4.current copy of terms and conditions as varied.
5. current statement of account , signed on behalf of tesco bank.
additions documentation
copy of account statement and transaction report.
the enclosed documentation illustrates that there is a debt outstanding and as such is proof of the debt
the debt remains enforceable and tesco bank will proceed with taking appropriate steps to recover this debt and register your account as defaulted on credit agencies ( strange thing is they registered me as defaulted over one year ago)!!
On looking at the credit agreement, imo it seems accurate, it has my name and address and creditors nme and address when account was opened, the terms and conditions, including thr cost of credit , ( apr) when i have to make payments, and cancellation rights and any other documents.
the only oddball thing i can see is the apr%-- it is ONLY showing as 0% for purchase, cash withdrawals, balance transfers, money transfers, fees balance handing fee,0%, money transfer fee0%, cash transaction fee 3.99%, cash withdrawal fee,0%, foreign exchange fee 2.5%, over limit fee 0%, late payment fee 0%.
but i have done 2 balance transfers on it at a cost of £22 and £11 fees depending on how much i transferred one, 1. when i instantly opened it and did a transfer and 2, in 2017 transferring another card. but the terms in above paragraph say
AND is the 0% interest cos the debt has defaulted and interest on my dmp are now 0%, or more likely cos when i took the account it was always interest free balance transfer offer for a certain period ????, or was there never a 0% interest period? that is my problem, i dont know.!!! as when i opened it in 2015, i did an immediate balance transfer to it of another card, fee of £27.55 and took it to the available tesco limit at that point., then i paid on time, reducing balance, 18 months later i got balance increase offer,, so i then did another balance transfer which i explain on next paragraph
BUT on the statement it shows transactions back to Jan 2015 when account opened, i can only see interest added a few months after i did a balance transfer of another credit card debt in august 2017, a transfer fee of £11.60,onto the tesco balance in 2017, from dec 2017 it was constant monthly interest.( was this a 6 month interest free balance transfer offer)??? But i used the card from day one in 2015, and started spending on it, i had some free balance left over like i said in 2017 of £400, which i did a balance transfer, where the first ever interest hit me in december 2017.
it also shows i made the min payment of £25 direct debit for 2 yrs, then it went to £41, £39, £41, £43 a variety of payments i made but the balance was roughly the same at that point £1365 of a max limit of £1600.
tbh it looks like i will have to pay the £1120 balance via my own dmp monthly payments now which I'm planning on setting up.,and it is enforceable, it does shows how to pay, and the one i fancy is faster payments by using their sort code and account number and my tesco bank credit card debt number via my bank account., is that a standing order or what ?? cos it doesnt use the words standing order, just faster payments.

i think you have to wait until the debt is sold on and then request the CCA as it stays with the original creditor. Once it is sold on it seems harder for the debt company to obtain it.0

Tesco seemed to react fast with my CCA request.wasnt expecting a knock at the door from postman.expect postman knock tomorrow as wife has similar debt with Tesco and CCA request done.
just trying to rack my brains if it was a 0% interest free balance transfer credit card offer from Tesco and that's why I got the card.
also is Tesco faster payment method where I use their bank account number and sort code and my Tesco credit card debt ref number and then make a payment via my bank account the very same thing as a standing order?( cos I'm coming off stepchange.i told stepchange .no more payments to stepchange until CCA letter replies)
so how fast do you reckon I should make my Tesco payment? cos I'm trying to build as big an emergency fund as fast as possible. as Tesco debt defaulted over 20 months ago,so.it's not as simple as e.g. avoid paying for say 6 months until it defaults. avoid letters .calls etc. cos it has defaulted already..and 90% of my other debts defaulted ages ago.
more CCA letters due in the post.i guess it's the PRA one I'm mainly waiting on cos they are really the only one that has bought any of my debts from memory and it's the biggest debt.
I guess Tesco sending it signed for special delivery is them having ammo that they definitely sent me their response in the post and I couldn't say well you never ever sent me anything back.
I have also requested CCA from debt collection companies who are dealing with most of my other debts( these are the ones where my monthly repayment payment goes to. from stepchange).these debt collection companies haven't actually bought t the debt.they are just the acting agents.
so these collection companies ,is it them that has to provide the CCA or is it the bank etc they are acting for. because I wrote the letters to the debt collection companies not the original creditor where I knew the debt hadn't yet ever been sold.( unless the debt was sold I then wrote to the new debt owner)basically the names and addresses of each company where stepchange pays my money to each month.
cos one bit of confusion has happened.i have debt with drafty loans who use a 3rd party to collect.i then got an email 2 weeks ago saying drafty are now back to collecting it.so I sent CCA letter to drafty. but in that time the 3rd party said to me they are now recollecting it
drafty have obviously decided they don't want to deal with it again.( think it's cos I offered them a much lower payment last month)
I did live help with 3rd party cos I questioned the balance .I said in the live help by the way I had sent a CCA letter to drafty.they said no problem sir we will email you the consumer credit agreement.i said no.its drafty loans I'm due it from ( and anyway will not accept email cc agreement.must be via the post)cos that was the last known company that was collecting the payment when I wrote the cca letter.Christians Against Poverty solved my debt problem, when all other debt charities failed. That was a quick response from Tesco. I requested a CCA from PRA group for an old MBNA debt about the same time as you requested yours, not heard anything yet. Good luck with the others you have requested.
I will leave others who have far more knowledge than me to advise on best way to make payments and other questions.1 -

I said can't show you who it's from sorry!
basically the customer wanted their regular letters, but if it was a recorded debt letter they were expecting, they would say to me , sorry mate ,he/she don't live here. my manager ended up blocking all letters to a customer cos they kept saying sorry he/she don't live here anymore whenever they got a recorded letter.
