Resolve call / Capquest

Hi,

My partner has received a letter from Capquest/Resolve call today explaining the account has now been passed to the latter for a home visit.

The debt must be over 20+ years old, and they have never acknowledged it or made any payments towards it.

There is a Ring doorbell at the address, do I have to answer the door if they turn up, give any details or confirm who lives at the address?

What is the best course of action from here? Is the debt statute-barred?

Any help would be greatly appreciated!

    If you do see someone you don't recognize at the door ask them who they are and if you are not happy tell them to go away.
    If you go down to the woods today you better not go alone.

    You don`t have to do anything, confirm anything, or even say hello, they are just self employed collection agents, no power to do anything, plenty of threads on this company, and yes, the debt will be long since statute barred, and they are probably well aware it is too.

    Send Capquest the statute barred letter, don`t engage otherwise, ignore the doorstep mob, just tell them to go away, they can`t do anything, and again, don`t engage with them.

    Starting a conversation is the last thing you should do, take the fifth, and say nothing.

    They like to buy up unenforceable debts and try to cash in on them hoping you are unaware of the limitation act in this country.

    Has it defaulted? If it has and your partner hasn't made any payments or acknowledged it in writing then it will be statute barred.

    Resolvecall aren't bailiffs and have no more power than a double glazing salesman knocking, if they do turn turn then just ask them to leave or don't answer the door at all. DCAs play a game a game of fear, they know that a lot of people don't realise that they aren't bailiffs so they mention doorstep visits to scare people into paying. Also just because they say they may do something doesn't mean they will, they have standard scare letters they send out.

    If it's statute barred then there is a statute barred letter here somewhere that you should be able to send.

    The only reason why you would not acknowledge a debt in writing, would be if the limitation period were in any doubt.

    If you were not quite sure that 6 years had elapsed, that`s the only time you would need to be careful, if you were unsure of your dates, you would risk re-starting the 6 year limitation clock by acknowledging it.

    Otherwise acknowledgement of a debt means absolutely nothing, so what if you say, yup, that debt is mine, now what ya gonna do ?

    Other than in the circumstances above, it changes nothing whether you acknowledge it or not, its just a rouse debt collectors use to make you think you have to pay it, smoke and mirrors.
