Hi im just looking for some advice. I've received some letters from Capquest out of the blue, saying they've taking over the loan recovery from an egg loan and a credit & store cards from 2003. 
I was on a debt management plan with Payplan and actually paid settlements for all these loans and cards, in 2015 to Lowell, link and Cabot financials. 
My problem is I'm struggling to find the debt paid letters from them, as it being over 8 years ago since I paid them off. 
I was wondering what the best way to deal with this is. I've not paid or had any dealings with anyone since then and they're not on any of my credit files.

    We've seen some other letters like this. They don't seem to be asking for money, and they can't enforce anything because after this length of time it would be statute barred.

    It seems to be some sort of internal requirement to write.

    So unless they decide to get more aggressive, you can just ignore them

    Brilliant thank you. It's just a bit of shock
    To receive a letter like this after think youve settled everything 8 or so years later.

    If you have not paid anything towards a debt for 6 years, it is statute barred. Even if they applied for a CCJ before the time was up, 6 years later they require court permission to enforce the debt if they'd not enforced it.

    Should I just leave it until the aggressive or will I contact them and say that? 
  • Entirely up to you. If you want to send the SB letter then fine but I would leave it and let them waste the money on letters and postage. If they send a letter before action ( which I don’t think they ever will) then send them the SB letter. 

    I have had something similar from Lowell for something that isn’t mine and I just smile to think that they are having to pay for the paper, envelope, postage and for a person to stuff it in the envelope and it’s keeping my lovely postie in a job.

    Could be that a balance remained unpaid, possibly the remainder left over from a settlement offer, and that has been sold on to Capquest, I`m just thinking of possibilities here, anyway, the letter will be, as others have said, just for information purposes.

    If they write again this time wanting money from you, then you should respond promptly with the statute barred letter.

    Regardless of your previous dealings in debt management etc, that occurred over 6 years ago, and the limitation period in England & Wales is 6 years (5 years in Scotland) so any debt that they may say you owe from that time period, will now be statute barred.

    Essentially this means they cannot take legal action to recover the balance from you, the debt may still exist (in Scotland it is extinguished) but it is not enforceable, usually telling them so officially, in writing will put the matter to bed once and for all, and they will move on to easier targets.

    Thanks for this, is there an adddress for Capquest that I should send the statute barred letter? I keep finding different ones online and there’s none on the letter. I got another letter from today saying resolve call were goin to call to my house 😬

    You could hand the letter to resolvecall when they visit. Saves a stamp.

  • I sent a letter to Capquest and 1 to Resolvecall yesterday. Today I had an email from Resolvecall that they are no longer dealing and handed back to Capquest
