Fixing mortgage deals

I fixed a mortgage deal in July which will begin on 2nd Nov - since then the rate has gone down with this bank. They have said I cannot change to the lower rate as it is not 14 days before but the govt charter says I should be able to change this up until the new deal starts and this bank signed up to the charter. Should I be able to change to the lower rate.
