Tax Free Childcare Return to Work

We’d like to open a Tax-Free Childcare account for our child going to nursery in January.
My wife is currently on maternity leave. Her return to work date is mid-November, however she will immediately be taking all her accrued annual leave so she won’t technically be ‘working’ until the start of January.
The scheme rules states you can apply whilst “on shared parental, maternity, paternity or adoption leave and you’re going back to work within 31 days of the date you first applied.”
Does this mean we can apply 31 days before her official return in mid-November or 31 days before her actual return in January?
