there was a recent post on the bankruptcy threads about a guy with £100000 in debt that went bankrupt then went to min wage job so that had no IPA at all all debts wiped out
he had no problems.he said if you plan it well.you should be able to write off everything.which he did .
he never got asked why did you go min wage.why did you make it that you had no excess money at end of week for an IPA
at the end of the bankruptcy he went back to much higher paid job.
and tbh my wife is exhausted in her job.i said if I land a great job you can be a housewife and it hit me this morning that she would still be entitled to a DRO even if I got a great job.
as previously we thought just carry on with our dmps in our lower paid jobs.then I thought what would happen if I get this job.then my earnings could cover the whole DMP for both of us.then I thought I will do my debts with a dmp and you do your debts with a DROChristians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

can you go back to my initial questions in my first post.
with reference to all points raised. in particular how she puts down zero expenses as I would pay all as when we did our previous initial DRO application with CAB the guy said it would fail as neither of us doesn't have enough money to support each other.hence we would both be in negative deficit
but with this new job my earnings would cover all my wife's expenses thus she could put down zero income and zero expenses.
I'm not asking a moral debate I'm asking that she is within her right to do a DRO as she has no income and no expenses and can't afford her debts.
I can appreciate that if you give up a job and Claim benefits the DWP can sanction you for 13 weeks at reduced benefit.
but she isn't a job seeker.thus no worries there.
the worst that could happen is a DRO failed and she is made bankrupt. with no earnings. she would still be debt free in 12 months and no IPA.
I'm not asking should she does this DRO.im asking can she do it and how does she answer the questions I asked.Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

A DRO is designed to remove your debt, and allow you to live within an affordable budget, without the level of debt making that an impossibility.
On paper, your wife`s situation would not be helped by a DRO, although your explanation says differently, the factors you mention would not be taken into account, as you are man and wife, your income would have to be included in the budgeting calculations, see what @fatbelly thinks.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. The rules and guidance for DROs are here
https://www.gov.uk/guidance/debt-relief-orders-guidance-for-debt-advisers
There is no deprivation of income rule. Let me know if you find one.
Prtner income is used to determine share of expenses but clearly zero income, zero expenses.
Your problem is not with the Insolvency Service but with the 'competent authority' who, like the Pharisees of old, appear to have added to the rules in order to make themselves appear holier than thou.
Try Money Wellness. Or ask the IMA if one of their intermediaries is in your area.1 -
what do you mean. would she be entitled on a zero income zero expenses as I would cover all household expenses
and again there is no law to force here to claim JSA or be a job seeker.Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

tbh I knew more than the CAB guy about certain aspects. he appeared to be doing a script q and a.not answering all my questions.
so does it appear nothing could stop the DRO being approved as she has no car.savings and will be on a zero income zero expenses non job seeker.no benefits claimed. again no income means she can't pay a penny towards household expenses and there is no DRO rule for giving up her job. and again no rule to force her to claim JSA.
a yes or no
thing is it's the CAB guy that puts the application forward.i can't do it. I have no choice.Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

based on our circumstances. DMP..iva . bankruptcy.dro.choices
it seems dro would be the cheapest and fastest way to get rid of debt for her .we own no house assets.
yes our DMP is what we are doing at mo.
but I expect to know about this job in days
and .if she goes to a zero income zero hours.what she does after their 12 month period is her choice eg go bk to work or remain a housewife on my higher wages to support the householdChristians Against Poverty solved my debt problem, when all other debt charities failed. del monte man say yes
.but the CAB guy said I think everyone has to claim benefits if you can if you are doing a DRO.he said it is expected .think he was plucking that reply out of thin air and a guess .his opinion.
he never said it is a legal requirement.
plus again to all those that replied.
so wife simply states zero income and zero expenses in her application sheet. as there will be a section for my income which will relate to the point I will be 100% of the expenses costs.
and DRO applications fail cos if above the£75 month limit or car and savings above£2000.
she has neither hence DRO must be approved
plus how does with show proof of zero income as the CAB guy wanted 2 months proof of income or benefits she would go to zero income immediately. when I get my new job.
and like I wrote earlier the guy with £100000 in debt choose bankruptcy and then choose as low income a job as possible for 12 months so no ipa.
he simply said know the rules and plan accordingly.Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

No one can be forced to claim benefits, yes it is expected, but by no means compulsory.
And yes, pre-planning is everything, as long as you stay within the rules, anything goes in my book.
If the roles were reversed, creditors within reason, will use every means available to them, to get what they want, why shouldn`t you.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
