    Any clues as to the grounds use to argue that the FCA's August 2019 deadline for complaints about commissions under Plevin shouldn't apply?

    It’s based on the Consumer Credit Act and the banks charging extortionately high secret commissions.
    The previous claims were based on mis-selling Eg you didn’t need payment protection insurance  because you were retired. 
    A Supreme Court decision this week helped to consolidate the position that these claims for the high, undisclosed secret commissions have to be allowed.

    This is not news as its being going on a while.   Some  CMCs believe that they can get a better outcome using the courts to get a ruling based on plevin rather than the previous FCA ruling based on plevin.   They believe the courts are more likely to require a full refund whilst the FCA said only the excess over 50% should be refunded.  It is untested and they have been building numbers.

  • Here we go again and MSE is promoting the dubious work practices of this firm. They have been sending in spurious requests for some time now with the obvious business practice of throwing a hole heap of rubbish and seeing what sticks.This is another firm that is borrowing huge amounts of money, in the hope that they will get it back after flogging another dead horse.     I think the first ever group legal claim for PPI which stops the banks blocking valid claims is news.
    I also think it’ll be news to many people that the banks were charging excessive secret commissions of up to 95 per cent.
    Never mind the group claim, the banks  should just be ordered to refund the customers. That way, you wouldn’t need any law firms of CMCs.
  • We've got forms for this group claim and considering whether to proceed. What did concern us was getting a read-receipt to an email saying:

    'On 30 June 2023 Hattons Legal Services Limited (Company No: 09771400) t/a Hattons Solicitors (Previous SRA No: 628665) ceased operating as a regulated legal practice.

    'All existing matters have been transferred to alternative law firms and will continue without interruption. Your email will now be redirected to the appropriate handler and a response will be provided shortly.

    We thank you for your patience during this transition.'

    But they're still using the Hattons email address.
