Paternity Pay

Employer (a county council) has taken my paternity pay this month (child is 15 months old!). Just wondering whether this is OK? I nlunderstand it needed to he paid but the fact that its been this long is worrying. Is there a time limit on when they could take it? Or is it just bad practice on their part?

What do you mean by "taken"? That they've recovered a previous overpayment?

Sorry. For clarity it's been deducted from my pay as was entitled to 2 weeks leave (1 week at full pay, 1 week at half pay).

So there has been a justified deduction from your pay?
Owing to you having taken more than 2 weeks leave perhaps - you've not given much detail.
And this deduction should have been taken over a year ago (again I'm guessing really).
I think the bottom line is that you owe it

How much is this deduction relative to your pay? If it is a large amount it would be good practice to take it over several pay packets, particularly as they have taken so long to make the correction. (Note: good practice, but not obligatory)

  • Not doubting the fact that it is owed. But the correct procedure according to policy is for it to come from my next pay packet. Not a year later

When it didn't come from your next pay packet a year ago did you highlight it to your employer or hope you'd get away without paying it back?
