Bankruptcy and expenses help

  • No I originally filled them in myself on the bankruptcy application, I rang step change who wanted to put me in an Iva but I wasn’t happy about the terms. I then rang the national debt line who went through it all and I adjusted a few things. But I will go on the website and see what it says. I’ve read things aren’t allowed to be I clued like birthdays etc so wasn’t sure.
The council was the old house that had the house fire. Apparently they wanted another 2 weeks yet it wasn’t habitable to live in so I refused point blank to pay it. I am fully up to date with rent council tax in the temp accommodation we are in.
I am so stressed with it all thinking they will say I have loads to pay into an income payment thing when I’m barely scraping by as it is.
Go car credit is hire purchase but the car has gone back.

You absolutely do not need an IVA, you have no assets to protect. It's annoying that they push those on to people that are at their most vulnerable and not thinking reasonably. But anyway you don't need one.

I can't be 100% correct but it is very unlikely that you will have an IPA with the bankruptcy, you have literally nothing left. I doubt they will impose payments that you can't afford as you'll just be in debt again.

With regards to things not being allowed like birthdays just add that money to groceries. I actually think your grocery figure is a bit low. But I'm not an expert.

The old rent will be ok in the bankruptcy. As you no longer live in where it's attached to.

If, after you've tried the stepchange budget list, all your figures will be ok. Will you be pressing the submit button on the bankruptcy?

Correct...an IPA can come into effect IF you have £20 or more left over per month after all living expensed are paid.

  • I have been on the step change website and it gives ideas but some things seem okay then some I’m not too sure. For example my eye sight is terrible and I wear contact lenses, it shows a budget of £0 of people with the same amount of children when I actually pay over £30 per month. I will be submitting as soon as possible I just wanted to make sure my figures were okay before I did. Hoping @sourcrates could check it over before I do xx

Your budget will be judged against a standard financial statement, only you know what your actual costs are, anything that stands out to the OR, they will ask you about, as long as the cost is reasonably justifiable, it will be allowed.

This may be a good time to re-assess your lifestyle choices, £30 on smoking may not be an allowable expense, maybe time to quit, there`s lots of help available.

The allowances in bankruptcy are quite generous, remember it`s designed so that you can manage a budget without the need for credit, it`s not a punishment of any sort, good luck.
