There's more to this than meet the eye, if she has been filing every year then the overpayment of tax would be identified as soon as the return is filed, not 3 years later.

As usual, there is missing information and other parts are being drip fed.

Most people on PAYE tax do not have to file.

Being offshore is no excuse, the deadlines are the same every year, you can file from 6th April until the following 31st January.

Suggest you and your daughter get onto the SA website and actually find out what she needs to do year on year as neither of you appear to understand the system.

I think most people would struggle to help as you haven't really explained clearly what the issue is.

Your thread title refers to late payment charges.  Late payment charges virtually always only apply after a return has been filed and there is some tax due.

But then you refer to her not completing a Self Assessment return.

    Has a return been filed?

Irrespective of that why was a return necessary, that could well be key.

The letters title is  “self assessment-penalties for late filing and late payment “

Doesn’t everyone have to do a self assessment ?
    Most. Definitely. Not

I’m not entirely sure HMRC understand the system.

Prior to working on boats she was both paye and self employed at that time I got my accountant to deal with it. I’m only repeating what’s on the latest statement.

My sister has lived in Italy for over 10 years I don’t think she has fill out a self assessment every year ?

    You’re not kidding 😂
  • Sounds to me like it would be easier, quicker and certainly less stressful to get an accountant to deal with the situation.

I live in UK and don't need to fill out a self assessment every year.  There are many thousands of people in UK who do not need to fill out a self assessment each year.

it depends on your circumstances whether you need to or not.
