Old CCJ 8 years old from a 15 year old debt

Hello I hope someone can help me. I have been contacted by a debt company about a debt amount of 1300 from many years ago (15 plus) . I sent the statue barred letter back and they say there was a ccj issued in 2015 (so 8 years ago). I got advice and was told to ring my local county court and ask if it’s
enforceable . The court lady said it’s so old it isn’t even on their system anymore. Does anyone know if they can still enforce this? I think it may be a catalogue type debt.  Thank you in advance

Relax! A CCJ will show on your credit file and on the Court Register for upto 6 years, after which time it won't appear, even if unpaid.

After this time if a creditor wants to take action for recovery they first have to get permission of the Court.

I suspect your creditor may have sold on a load of debts including yours to an agency to recover against and they're relying on inertia and scare tactics to either have you scared into paying it or negotiating a lower figure they'll say is acceptable to their client.

In your position I would email or write to them saying you have no knowledge of this debt and in any event as it is now more than 6 years old it will have been removed from the Court Register and you consider that to be an end of the matter.

This link goes to the national debt helpline, scroll down to the guidelines for CCJs:

  • Thanks so much for taking the time to reply. I will read the guidance you linked.I will write back to them saying this. So do you think they will go back to try to get a new ccj ? Surely a judge wouldn’t approve this after it’s been 8 years from ccj/ 15 from debt? I’ve never moved out of the country but have loved addresses. They are threatening to come to my house now it’s so worrying

No, they can`t obtain a new CCJ, nor can they enforce the current one, without court approval, which at this late stage in proceedings would be unlikely.

You should just inform them you are aware the judgement requires court approval to enforce due to its age, once they get that please get back in touch.

That will probably be the last you will hear from them.
