Hello all

I havent been on the site for a while, I really dont know what to do at the moment - I have received a letter from Northern Rock saying that they are taking me to court to get a charge against my property - what does this mean in english? do I have to sell up to pay off my debt? I have a joint mortgage will this affect my wifes credit rating? I am currently with the CCCS but obviously its xmas so noone there. there used to be a guy on here from the CCCS is he still posting?
pleas help me

    Hi,

    A charging order means if you sell your property the building society will get a cut. I think they have to go to court to do it.

    If you go to one of the debt charities websites, they may have more info for you. Other people will be along to help you soon.

  • If the debt you have with NR is unsecured then they cannot reprocess your property to recover the outstanding amount. A charging order is obtained via a court judgement and if awarded means that when you decide to sell your house then that sum has to piad to NR at that time. So you wont lose your house.

    As regards your credit rating, yes it will be recorded on your file and so impact that. If you and your OH have any joint loans, including the mortgage then the financial association with you will show on her file.

    Hope that helps to put your mind at ease, that you will not be out on the streets anytime soon, and you can enjoy the festive period.

    Take a look at the sticky about SOA and put one together, post it here if you want these good folk to give you suggestions to cut you outgoings to tackle this debt. Because once you have paid NR what you owe you can get the charging order removed

  • Just noticed you are currently using the CCCS, contact them in the new year, and explain this to them, but remember there is nothing NR can do either, as the courts shut down as well, so you will not have lost any time
