Faulty Car on HP

Hi in April 2022 I bought a Vauxhall Astra from evans Halshaw, 1 previous owner and first registered January 2020 with 7000 miles on the clock. In October of 2022 I had problems getting the car into first gear and took it to Evans Halshaw who diagnosed the car and said it needed a new engine which was covered under warranty, they had my car for 2 weeks and the engine was replaced car had only done 10,000 miles. 
Car passed first mot this year in January no advisory’s, serviced last month. On Saturday I was on the motorway when I light on the dash appeared saying Engine reduced power, I pulled off at services and engine management light came on. Took car back to garage on Tuesday and they now say it needs a new turbo at a cost to me of £2500 as it isn’t now under warranty. The car hasn’t even done 16000 miles now. What do I do surely the car isn’t fit for purpose- evans Halshaw will not do any thing. My car is on finance with Halifax- black horse. I have contacted them by telephone to reject who have 56 days to investigate. Do I drive the car? How can I go with no car for 2 months, I really don’t know what to do but surely I have some legal rights ? Thanks for any help you suggest I’m really desperate

    The warranty doesn't reset to zero when you have a repair done. Nor would an MOT involve any kind of test of the turbo. 
    If the dealer will not consider a claim, I would be contacting Vauxhall UK to request that they consider a contribution to the repair cost on the basis that a turbo should not fail at 16k miles. If that fails, you are down to your statutory rights under CRA 2015, which are wholly against EH as the vendor.
    No, don't drive the car. You have no entitlement to a replacement vehicle while it is off the road.
    No free lunch, and no free laptop ;)

    Hi thank you for your reply. I knew the replacement engine wouldn’t restart the warranty but surely the turbo issue shouldn’t have now gone too?
    Not sure what you mean about the CRA been against EH? Sorry

    Consumer Rights Act 2015 against Evans Halshaw.

    I’d be pressing Vauxhall UK for a large contribution (80%) towards the cost of replacing the turbo, then once done, get shot.

    Good luck, do remember to pop back and give an update.

    N/B - It appears that engine failure, gearbox failure and turbo’s are quite common on Vauxhalls of late so the more you can evidence that manufacturing defects obviously exist en masse then hopefully the greater chance you’ll get a significant contribution (I’d start at 100% with a view to settling at 80%).

    I found black horse quite fair when I rejected a car, I would let them investigate and see what the final response brings,, you always have the option to escalate to the financial ombudsman if required.

    As stated above, the turbo should not fail at 16000 miles, if the car has been correctly serviced you want a large contribution from vauxhall.

    Personally I would avoid EH and vauxhall going forward as they have no concept of after care

  • I'm also going through hell with Vauxhall customer care team and local dealership over a timing belt issue. Car has done under 30,000 miles and the wet timing belt needs to be replaced. Warranty team won't cover it  - car is under warranty until Dec 2023. Am arguing case with them but the customer service team are terrible to deal with, the dealership are even worse. I've spoken to 4 different people so far and have to go through every single detail again with them before they pass me to some else!

    Currently my car has been sitting on the drive since April and counting and I'm still paying nearly £400 each month on the finance

    Hello Just to update. Vauxhall customer service contacted me today to say they will cover the costs of repair in full - I’ve just dropped my car off and have been given a courtesy car. The parts are on back order turbo & vac pump so I don’t know how long they will have my car for.
    Good luck evenstar it’s so frustrating, but I’m just glad it’s getting covered
