No pay increase everyone else has

My OH been in a job 10 months and its transpired that all other employees been given a 5 per cent pay rise . My OH hasnt recieved it. There are a total of 17 employees. Wether they are going down the line of must of been there 12 months seems abit unfair to expect someone to do same job as at least 2 others for another 12 months on less money before another if there is one a wage review.. Hes hoping that when he says something they will say you will get it when your 12 months is up but i cant see it.

    There is no legal entitlement to a pay rise. I know people who've worked at companies that don't do an annual salary review and the only people who get one are those who complain enough. Those same companies then wonder why their staff turnover is so high. 

    He can certainly ask for a pay rise. The answer might be that you have to be at the company at least 12 months and the salary review happens at a set time each year. 

    Was he on the same salary as the other two people before their 5% raise? He might have been recruited on a higher salary, since the employer knew he wasn't going to be eligible for the next review.

    He needs to ask the question to his employer, doesn't he - but reading his contract first would be a good step. That should clarify the date of any salary review.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    It may well be a case that a salary review only takes place once a year and the employee must have been with the company for a minimum of 12 months to qualify.  As long as it applied to all employees, and any excluded employees still earn at least the NMW it is perfectly legal.  A slightly different situation but I joined a company 2 days too late to qualify for their annual bonus scheme which worked exactly as described above.

    In a previous job I didn't get an annual pay rise as I hadn't been with the company for 12 months but it was stated in my contract and I was aware it would happen.

    Morally maybe but it is not legally unfair unless the real reason is because of unlawful discrimination (e.g race, religion, gender etc). The only exception would be if his pay were to fall below the national minimum wage.

    Otherwise any pay rise is a matter for negotiation and there is no automatic right to one.

    Not even sure this is morally unfair unless it isn't set out in their terms or is being applied unfairly.

    Seems reasonable enough that they reward those who have been with the company a year or more. Otherwise someone could join for two weeks and receive a payrise without commitment. If they had wanted to apply that to a new salary they would have just advertised it that way.

    Also agree with the above. The role may already have been benchmarked higher.

    My firm has the same clause, I've just had to challenge it as they attempted to give me zero (but I have been there more than 12 months). The reason being I received a pay rise earlier in the year to bring me in band and whilst I confirmed at the time it wouldn't affect my annual contractual uplift review, they changed their mind.  This was found to be unfair, and I was given a small uplift.

    This may be challenged, as my team lead actually told the entire team in a weekly call they'd asked for more and stipulated the amount, and a subject access revealed that even in my case this was granted by HR, with my manager instead arguing the minimal despite a *extremely positive appraisal* and having it in writing that I was the second best in the team, and that was only down to experience. I wasn't going to argue but based on other things the SAR produced it probably is worth it now.

    In your case though its seems quite normal to wait a year before becoming eligible - it does suck :( but I don't think you can do a lot about it except check the contract. It was quite clearly stated in mine.

    All other employees including those there less than 12 months or aren't there any? Personally I think wanting a pay rise before 12 months is up is cheeky and inflation may be quite different in 2 months compared to what it is now.
