Change of contract advice please

Hiya hubby works full time over 25 years service , his contracted days could b changed to include Saturdays with Monday off instead. This do not suit us at all as we have weekend off together however really don’t want to lose job over it. Could anyone explain what his employer legal have to do as I’m sure they will cut corners wherever possible. Already heard everyone has to do this not exceptions. My hubby has yet to have his meeting to discuss this and wants to go in prepared. Thanking you

    It is easier than most people realise for an employer to change an employee's contract if they go about it correctly and particularly if there are sound business reasons for doing so. Jobs evolve over time and what was a good arrangement for both sides many years ago may well not be now. For that reason the law does not see employment contracts as set in stone.

    Obviously there may be room for negotiation and compromise but, if they can't agree, the employer can impose the change. That would leave him with the options of accepting or resigning and claiming unfair dismissal (not constructive unfair dismissal in such circumstances despite the resignation). It would then be up to a tribunal to decide if the change was fair or not. If he wins he would get some compensation but the tribunal can't force the employer to revert to how it was.

    Has he actually had a conversation with them about how things are going to work in practice? Has he spoken to colleagues to get their views as some may be wanting weekend work.

    Contracts give employers flexibility but doesnt necessarily mean they will frequently use that. My last perm role didnt specify my days or hours, just an anticipated average of 40 hours a week as per business need. In reality I only ever worked mon-fri and generally office hours (unless doing project work with overseas colleagues)

    He’s currently working Monday to Fri! He’s day will change to Saturday with hopefully Monday off !  His employer definitely don’t do flexibility. Majority are not happy hubby one last to been seen so he’s had a lot of comments from rest. So when his time for meeting he has got little know about what’s going on. So far it sound like any questions asked they don’t have no answers

    That may not be the case. What is the employer's reason for wanting to make this change? Have they, for example, decided to open on Saturdays and close Mondays? Maybe business levels make it uneconomic to be open on a Monday? Is the business struggling?

    Without giving too much away, what type of business?

    They currently already open on Saturday with people working but because no one want to do it they are making everyone do it. It’s a poorly run company with no care for employees but living in a area where jobs are scarce we just have to suck it up.
