But at 11pm why didn't the driver just park on-street? Never, ever search for a 'car park' to park a car at night (or on a Sunday). You can always use a single yellow or a permit bay at 11pm.
When I visit a city (even a big or busy car-hating one like Brighton) I never use a car park on a Sunday or after 7pm. Went there this week, found a single yellow line, left the car there free, all evening. That is where to park in towns & cities. Wait for a proper LBC giving you 30 days to respond. What you have now is nothing more than a debt collection letter. Read the NEWBIES FAQ Announcement, fourth post, to appraise yourself with how to deal with one of those.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

To be clear, we are nearly there; it's not a petition or some weak campaign, it's a final push on a law already passed, to cap the £PCN levels and ban the fake DRA fees.
The Government has a Call for Evidence open right now.
We are wanting photos of unmanaged car parks, Hospital car park signs near you that show £50 or £60 as the deterrent, and Aldi, Asda, Tesco or Sainsburys £70 signs please.

Hi all. So, I finally got a letter from Gladstones Letter before claim back in November 2025. Completely forgot that i had used this and posted it on here. Well, I had emailed them with the following -

Dear Sir/Madam,
I am the registered keeper and deny any liability for this charge. No admission is made as to the identity of the driver.
This matter relates to alleged parking at night when the MSGL Fashions premises were closed. No method existed for any driver to obtain authorisation or become a customer. Signage was not sufficiently visible or illuminated to form any contract.
If your client alleges the driver “left site”, strict proof is required.
Please supply:
1. Original PCN & all notices
2. All photos, timestamps & ANPR logs
3. Copies of signage from 06/05/2023 including night-time images
4. Unredacted landowner contract
5. Records of the prior appeal
6. Evidence of POFA compliance
7. Breakdown and justification for added sums
This request is made under the Pre-Action Protocol. Please place the matter on hold for 30 days while I review the evidence.

Dear Mr ****,
Further to your letter dated 4th November 2025.
As requested, please find evidence pack attached for your records we trust the contents to be self-explanatory.
We remind you it is the responsibility of the driver to ensure they comply with the parking regulations on site and thus, as it is abundantly clear you have failed to do so, we are satisfied the charges have been issued correctly and all sums owing are due in full.
Notwithstanding the above, if it is the case that you were not the driver of the vehicle at the material time, you are of course at liberty to transfer liability should you wish.
We refer you to the provisions made within PoFA 2012 when transferring liability. To assist, PoFA states that the registered keeper must provide the drivers name and address to the parking operator, and pass the Notice of Keeper to the driver.
Accordingly, in order to transfer liability, please confirm the full name and UK serviceable address of the driver.
In addition, and in order for our Client to satisfy themselves as to the validity of the details provided, we kindly request the following information:
- Proof of valid insurance confirming the nominated driver was insured to drive the vehicle at the time.
- A copy of the nominated driver’s driving licence.
Please ensure the information is provided no later than the 3rd December 2025, as any response received after this date may not be considered as legal proceedings may have been issued.

I emailed them back on 28/11/25 with the following -
Dear Gladstones solicitors,
Thank you for your email and the attached evidence pack.
I also confirm that I have received the Subject Access Request (SAR) disclosure from your client, Euro Parking Services Ltd.
For the avoidance of doubt, I am the registered keeper only.
No admission is made as to the identity of the driver.
I am under no legal obligation to identify the driver, and I will not be doing so.Your request for personal data such as a driving licence, insurance documents, or any further evidence relating to a third party has no basis in PoFA 2012 or in law, and is declined.
Having reviewed both your “evidence pack” and the SAR disclosure:
• The CCTV footage provided shows only the passenger exiting the vehicle.
• There is no footage or evidence showing the driver at any time.
• There is no evidence whatsoever that the driver left the premises.
• There is no evidence that any alleged contractual terms were communicated or breached.Accordingly, your client cannot establish the identity of the driver and therefore cannot pursue the driver directly.
In addition, you may only pursue me as the keeper if your client has fully complied with Schedule 4 of the Protection of Freedoms Act 2012 (PoFA). Based on the documents received, I dispute that your client has complied with PoFA, and this will form part of my defence should proceedings be issued.
I also note that the “evidence pack” you provided contains an old Letter Before Claim dated August 2023, which does not relate to the current Letter Before Claim dated 24 October 2025. The pack does not comply with the requirements of the Pre-Action Protocol for Debt Claims and is missing multiple mandatory documents.
The alleged debt remains fully disputed, and the matter is on hold for 30 days pending the provision of the required information.

Thank you for your recent email and for confirming that you are the registered keeper of the vehicle. We note your position that no admission is made as to the identity of the driver and that you do not intend to provide any further personal data or documents.
Our client’s position is that a parking charge of £160.00 remains outstanding in respect of the above contravention and that it is entitled to pursue recovery of that sum from you as registered keeper and/or at law. Your references to the Protection of Freedoms Act 2012 and the adequacy of our client’s evidence are noted and will be considered should proceedings be issued, but they do not of themselves extinguish the alleged debt.
The evidence pack previously provided sets out the basis on which the charge was issued, including the alleged breach of the site terms and conditions and supporting imagery.
Unless full payment of £160.00 is received, or you provide material within that 30-day period which leads our client to alter its position, our client may instruct us to prepare a County Court claim without further notice, in accordance with the Pre-Action Protocol for Debt Claims.

Now i do not have any plans to email/contact/reply back and just wait and see what it is they will do. But wow they do love to put pressure on a individual.

Arrrgh ... no massive harm done but you should never have asked for evidence.
That's the last thing you want in a Gladstones claim case and that's why the template LBC reply deliberately doesn't ask the solicitor for any documents or evidence.
You WANT a vague claim form; a bare set of Particulars of Claim. It makes defending easy. Stop replying. Await the useless claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
