Employer asking for wages paid in advance back.

    Ah never mind I have just discovered that she had not been working there a while and had exhausted all her sick pay and it became wages this month again so they would like it back obv.

    I have told her to at least ask them for installments and that it will be a massive impact otherwise.

    They may accept or not as you say.

    Legally and morally she has no right hold on to the money or delay repayment. Legally it was as much her duty as the employer's to ensure that her pay was correct and not to spend any money that wasn't her's.

    From a practical point of view, as it will take them months to sue her for the money and enforce payment, they will almost certainly agree to some sensible repayment plan.

    She need to try and agree something with them fairly promptly and then stick to the agreement.

    Bear in mind though if she does delay they could start recovery pretty quickly and she might end up having to ay interest and costs so don't drag it out assuming that nothing will happen. 
    Realistically I think she'll need o aim to pay it back within 2-4 weeks
