Olio collection times

I have been checking my local Olio offerings and see that posts are often 10.30pm or later. However, 'same day' collection is required as these fresh items are on their last date. Is almost immediate collection strictly necessary or is this statement a legal requirement due to the date on the food? Would a 'first thing in the morning' collection ever be acceptable?
I'm asking here as I wouldn't want to put any of the collectors on the spot.

we often dont collect til 9 so time we get home and list it can be late and if something is Use By we are not allowed to hand them over the following day, it has to be before midnight of the same day.

I understand the late collection from the store and that there will be rules around UB dates, but it seems a shame that the stores don't release these items to Olio a day earlier, although they will hope to still sell them I guess. Surely anything collected late at night will be in a fridge or freezer until the next day by personal choice too.
.... Does a lot that is listed so late go to waste due to non collection? This is not a whinge; I am just interested.

UB things may look ok but it is illegal for us to give them out after the date. if you collect them and dont use them til next day that is your personal choice of course
personally in my squad we have very little waste but we do an Express store rather than a large one. when i have done a large store i didnt have any waste and i do think generally theres little UB that does goes to waste as its so highly in demand.
if we do get waste it tends to be bread products which as we live in a rural area goes to farms/rescue centres etc
