resolvecall visit !

Hi everyone, quick question, had a card/letter through my door yesterday from resolve call regarding a debt that was in a previous name. I haven’t been that name for over 12 years. I haven’t had no correspondence from them until the card came through my door yesterday. Surely this is statute barred? My credit file does not show any debts.  how do I proceed with this? Many thanks

    For written communications, the safe response is to send a prove-it letter as found in the stickies.

    Yes, it'll be statute barred and unenforceable and would have dropped off your credit file six years after the default. There has probably never been any court action.

    But just get them to explain to you in writing what this is.

    There is a flurry of activity on these sort of debts at the moment ahead of The FCA Consumer Duty that comes in at the end of July

    Thanks for your email.

    Due to the age of the file we would be unable to obtain any evidence, for this reason we have closed the file and returned this to our client. There will be no further contact from Resolvecall regarding this matter.

    Are you still looking to make a complaint? If so, can you please advise on the nature of your complaint?

    That's a result.

    I think part of the FCA Consumer Duty will be that debt buyers must not ask for payment on a statute barred debt without making it clear that they know the debt is statute barred.

    As things stand though, there's not really anything to complain about

    I don`t want to rain on your parade, but remember, they have only returned it to their client, hopefully the client will write this off as uncollectable, or they may just engage another DCA, I guess time will tell.
