Well we know what assuming does...

Well, "no further action is needed" is pretty distinct, don't you think?

I don't have the time to waste to sit in a phone queue for another 2 hours. Given the state that they're in, my guess is that my daughter will have left full time education by the time they pull their finger out in any case.

I would not be leaving things to assumption with CMS especially when you seem to be talking about large sums of money. If you do then you can't really complain when they come chasing you for arrears, can you?

OK do what you think is right. Please don't come back looking for sympathy or further advice in a few months time when CMS are chasing you for arrears though. Since you think you can write the rules to suit yourself you can just tell them that you are morally correct and can't afford to spend 2 hours on the phone while they empty your bank account and deduct half your wages.

The problem with CMS is they work on the previous year’s records.

When your pay goes up it can be a while before your cms goes up so you gain but at the same time when your pay goes down your left paying a higher amount on a lower wage.

Its a poor system I have seen from both sides as I pay my ex but my current girlfriend should be getting payments from an ex but isn’t and the cms are useless and very slow.

They are very slow and often a bit useless, but in common with every other government service they are deliberately underfunded so they're probably doing their best with the resources and tools they have.

The important thing from a user's POV though is that you need to make sure you are updating THEM with the proper information ASAP in line with their rules. When you start going off-piste and making up your own rules then when things can get very complicated.

Also in the examples you give you KNOW you are underpaying when you are gaining and you know that's going to catch up with you at some point so the smart thing to do would be to put aside the proper amount you should be paying for the future. Or tell them that you are underpaying.
