Capquest / resolvecall

Hi all,

I have had a letter from Capquest today stating they have passed an account to resolvecall. This is regarding an old credit card debt from 2002/03 which I have heard nothing about for over 15 years.

They tried to call me last week and sent a text today regarding a prospective home visit. How they got my number I dont know, probably off my credit file as my phone is in my other halfs name.

What is my best course of action regarding this? Await a visit even though they have no legal powers at my door or send a SB letter. Im not ringing or logging into their portal.

Your help would be appriciated

    I would send a prove-it letter.

    See what comes back. 

    Provided it is as straightforward as you think, then send the statute barred letter.

    Is the prove it on a sticky?

    Also is it common for them to chase a debt that old? I am not aware of any ccj back then that was attached to the account so if not why chase a debt that is SB? 19/20 years old.

    I also claimed back ppi in 2019 but as i read that would not have counted in me acknowledging the debt is this correct. Sorry for all the questions.

    Lots of people are unaware of the limitation act, and that bad debts are only enforceable for 6 years, companies such as this prey on that lack of knowledge, in the hope of getting a payday.

    Capquest appear to specialise in chasing such accounts, and use Resolvecall as the collection tool, you may be surprised to learn how many people just pay up without questioning their liability.

    You should always question everything.
    The account would already have been statute barred by the time you made the PPI claim.

    Im sending the letters today, so sending the prove it letter first will see what they have regarding the account? Do I need to send anything else with it? I did find the prove it letter but the link was broken.

    No, the provit letter simply asks for evidence of liability, without actually acknowledging anything.

    You can see if the OP of a thread has ever posted further on the subject by tapping on their name and looking at the bottom of the box that pops up showing their initial profile data, then on “comments”. In the case of this one, they’ve not been active on here for months I’m afraid.
