Extremely Confused.

So a bit of a back story. I was employed from September last year. I went for an interview beginning of January. I got the job and they requested references from my employer. At the end of January I needed surgery as I discovered I had skin cancer. I had it removed and then developed septicaemia from a wound. So I’ve been off poorly not getting any better. My employer wasn’t very helpful and a couple of weeks ago still on the sick I decided to hand my notice in. In my contract it read 1 week. Unfortunately the job I went for and got couldn’t hold the job and I didn’t go ahead with it. So my notice period finished last Friday. This week I’ve had phone call after phone call accusing me of taking this job and working. I wish I was well enough too. Then today my dad is an outside contractor and went in to fix a machine. He was talking with a women and telling her about my recent diagnosis. He then left literally about 10 minutes after he left I get a missed phone call and an angry voicemail asking me to ring my previous employer. She then started asking me if I was starting work next week and if I’d been for the interview. I then was told she had been on the website and my name was in the staffing list. I told her no I’m under sick note still and haven’t a clue why I’m still on the staff list. She then went on to say how everyone in my department was so angry that I’d been working at another place. My notice period I completed I no longer work for them and haven’t for the last week. What I think they may be up to is getting out of paying me my wages as I’m due to be paid up till the end of the month. My dad is due to go back on Monday to my old employer to fix something and I don’t really want him to be interrogated about something that has not happened or happening. What I do want to know is can they do this seeing as though I handed my notice in a week ago and was told verbally over the phone they accepted this. I don’t really want to go into next week with constant phone calls and emails off them seeing I’m no longer employed by them. Any advice would be greatly appreciated.

  • This is a bit confusing.  You say you worked your notice and haven’t been employed by them for the past week, but suggest they should be paying you up to the end of the month.  So unless you are due to be paid any accrued holiday,  I would have thought that you will only receive pay up to the end of your notice period.
  • Yes it’s for holiday pay she told me today they can’t process my p45 until the end of the month. And then went on to accuse me of starting a new job next week. It’s all very strange 
  • I’m thinking though I just don’t engage with my old employer. Surely they can’t integrate somebody who no longer works for them ?

    I agree just don’t respond.  Legally they do have to pay any accrued statutory holiday pay,  though of course it may not be a lot if their annual leave year started in January.   
    Were you being paid company sick pay or Statutory Sick Pay?  If it’s SSP make sure they give you form SSP1, to submit to DWP to claim it yourself.
  • I was being paid company sick pay but it had stopped.
    I be just checked my paye on the government gate way and it’s saying I left my employment on 4th April 2023. I get paid on 28th of the month. I don’t really understand what their game is but I will just ignore them.

    Hi OP

    I hope you are well now.

    On Monday, even with the help of posters here some of whom are very hot about things like this. Give ACAS a call and they will
    help you with what to do, say and the best way forward

    (I'm sure you wont want to but is there anyone in personnel that you trust etc that may be able to help/guide? Or the union rep for the co?)  But do call ACAS for good advice

    I would not ignore them: I'd send a letter or email, pointing out that you gave notice, you have been unwell, you have not started a new job, and you remain unwell but you are expecting to receive your final salary from them including holiday pay on x date. 

    Then maybe ignore phone calls and emails. 

    You could also check website of other employer and see if it's true you're showing there. If so, contact them and ask for website to be updated. Always politely, in the Hooe job may be available once you're fit again.

    I'd also agree with your dad what he might want to say. Your previous employer shouldn't be raising your employment situation with him, but if you're happy for him to confirm that you are not working but that it is not for him to discuss your personal affairs, it may help. That's because if he gives the correct response of "none of my business, stop asking" it may confirm your paranoid and out of order manager's suspicion. 

    By the way, are you in a union? If so, ask the branch for advice.
