TERMS AND CONDITIONS for “Rye Lane” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

 

1.ENTRY ROUTES AND COSTS	Entries are restricted to one entry per person.   Entry to the Competition is available via the following routes:   Online at www.KISSFMUK.com   Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	There will be six (6) winners of the Competition in total. The prize winners will be selected from those who successfully submit a written entry on the creative page describing their best unexpected love stories.   An entry will be deemed invalid if the entrant does not successfully complete the online entry form with a minimum of 20 words and a maximum of 150 words.    Entries will be judged on how entertaining, compelling, heart-warming and deserving the entry is. All entries will be judged by the KISS FM UK production team, the production manager, and an independent judge (the “Panel”).  The Panel’s decision is final.   We will be shortlisting entries from the open of the competition on the 08/03/2023 at 00.01 until the close of the competition online entry period on 19/03/2023 at 23:59. On shortlisting, we will require the semi-finalists to coherently explain and discuss their entry. The entry must be compelling and match the entry that was entered online. On being called during the entry period does not mean that the entrant has won, and they will only win on being told they are the winner by the production team.  There will be five (5) winning entries brought to air in total during Tyler’s show from 13/03/2023 to 17/03/2023 between 16:00 and 19:00. Exact timings of the competition within this broader timeframe will be given by the studio, upon contacting the semi-finalists. There will be one winner each day for each of these shows. Speaking to a member of the production team does not guarantee you have won the prize. All final decisions will rest with the KISS Radio Production Team. The KISS Production Team reserve the right to pre-record any part of this competition with contestants before the 'as-live' broadcast.     Additionally, there will be one (1) final online winner selected once the competition has closed, who will be contacted via email.
3. ENTRY PERIOD	Entries must be submitted during the following entry period:   From Wednesday 8th March 2023 at 00:01am (the “Start Time”) to Sunday 19th March 2023 at 23:59pm (“End Time”).   Entries received before the Start Time or after the End Time will be invalid.    If the winner cannot be contacted within 28 days from the date of the initial attempt to contact them, then we will select another entry until we have a winner that we are satisfied (at our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry.  Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to select a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. Each entrant is limited to winning one prize per competition. There is no limit on the value of a single prize that may be provided to the individual winners of a competition. However, so that we can ensure fairness of our competitions we reserve the right to prevent a person to win more than one (1) prize valued at £500 or more via any of our competitions in any given six (6) month period. For avoidance of doubt this means that an entrant will not be eligible to win any prize if the entrant has in the past six (6) months won a prize valued at £500 or more.  We reserve the right to disqualify your mobile phone number from future Competitions during this period. 5. THE PRIZE	Six (6) winners will receive the following prize (the “Prize”):   An Incredible Night Out For Two!    Prize package for 2 adults includes:    -       Return taxi transfers from winner’s home to nearest town/city (capped at 20 miles); -       Dinner at a top restaurant in winner’s location of choice, up to the value of £50 per person to cover food, drinks and service charge; -       Karaoke and drinks/cocktails at a karaoke bar in winner’s choice of location (includes an £80 bar tab to spend on drinks) and; -       2 x Tickets to see ‘Rye Lane’ at the cinema in winner’s chosen location   T&C’s for the prize:   Taxi transfers are capped at a maximum of 20 miles from the winner’s home address;  Winner and guest must travel together from the winner’s home address and no pick ups/drop offs will be permitted on route;  Winner and guest must travel at the same time with the same itinerary;  Both winner and guest must be over the age of 18;  All prize elements are subject to availability; If unavailable, experiences of a similar nature and value may be offered at prize provider’s discretion; Winners must contact prize provider with three preferred dates no later than six weeks prior;  All elements of the prize must be taken at the same time;  Prize is non-refundable and non-transferable; No cash alternative is available;  Prize is valid for 12 months from the date of notification of winning, and all travel must be completed within that time;  The prize cannot be taken from 19th December – 2nd January (Christmas and New Year), over UK public holidays, or over Easter Sunday;  Once booked, the prize cannot be amended or cancelled;  The prize excludes meals and drinks (except where specified above), excursions, attractions, treatments, car hire and personal expenses and anything not expressly included in the prize;  Dinner  available at the winner’s choice of restaurant or gastropub, to a maximum value of £100 (£50per person) to cover food, drinks and service charges;  Bar tab at karaoke bar to the maximum value of £80;  Cinema tickets for Rye Lane can only be provided while the film is in cinemas. If the winner chooses to take the prize when Rye Lane is no longer at the cinema, they can either have tickets to see the film prior to their prize experience while it’s still in cinemas, or they will receive a cinema gift card; The Prize Provider is Element London Ltd. Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy, which is accessible at https://element-london.com/element-london-privacy-policy-travel-english/

 

OTHER CONDITIONS

 

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station, or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings, or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS. 

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however, we are not obliged to, and our decision, in either case, is final and no correspondence will be entered into. 
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route. 
• We accept no liability for network, technical or signal errors, issues, or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition. 
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.
• We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
