Lowell debt not enforceable?

Hi everyone,

I have an old debt from Lowell, I sent them a letter saying it was statute barred(it's been 8+years). They replied saying court action was taken and provided a case number and court info. I contacted the court who confirmed they have no record of the case number, and no record of any cases against me. Also I know I've never received a CCJ. So after that I wrote to Lowell who just ignored me basically saying, it's not statute barred as a CCJ was issued (it wasn't, and there is no evidence of any court action)

So at this point, am I correct in thinking I can write to them a final time saying something along the lines of, there is no evidence of court action if you continue to pursue this debt I will be contacting the FCA etc to complain?

The only evidence they have of court action is a note on their "system" for my debt... a debt that's been bought and sold over 10 times!

Thanks all.

You've written to Lowell and stated your position. I would just file and ignore their letters now.

You can refer to the FCA but if they agree with Lowell then that doesn't help.

Even if what they say is correct, for a ccj over 6 years old they could not enforce it without specific permission of the court (that has no record of it).

They do know the law and know this one is dead. They will give up eventually.

Thanks fatbelly, that's certainly a lot easier on my side.
