Hi
I just wondered if anyone can clarify if company cars are included in the paying parents income calculations for child maintenance payments. The reason I ask is when my ex and I were together his company car was include in our income calculations putting us over the £50k threshold to be eligible for child benefit which left us owing £1000s . However I can’t find clarity for inclusion for child maintenance income surely it must be the same assessment rules ? Anyone had any experience either way please ?

It should be based on total gross income - pension contribution so if the company car is a benefit which impacts the top line gross income then yes it should be counted.0

In the case of the car BIK (benefit in kind) value being included as earned income to calculate the ANI (adjusted net income), that is correct in the case of entitlement to child benefit. ANI would usually be salary + BIK (car and others) - pension contributions - gift aid.bexb78 said:Hi

I can't advise on the rules in the case of calculation for maintenance payments.0
